Official Rules

 

NO PURCHASE OR PAYMENT NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT IMPROVE YOUR ODDS OF WINNING.

1. Sweepstakes Description. Homeowners Association Sweepstakes  (the “Sweepstakes”) begins May 24, 2022 at 9:00 a.m. Eastern Daylight Time (“EDT”) and ends June 3, 2022 at 11:59 p.m. EDT (“Entry Period”). The Sweepstakes is sponsored by The Suh Family Foundation (“Sponsor”).

2. Eligibility. To be eligible, you (“Participant”) must be a legal resident of the United States of America who, as of the time of the Entry Period, is at least 21 years of age. The following individuals are not eligible to enter or win a prize: employees, contractors, directors, and officers of the Sponsor, its parent companies, subsidiaries, affiliates, agents, marketing agencies, and any other parties involved in the administration of the Sweepstakes (“Sweepstakes Parties”) and each of the immediate family members of such excluded individuals (i.e., spouses, parents, children, siblings and the “steps” of each) and all persons living in the same household of each.

By participating in this Sweepstakes, Participant agrees to be bound by these official rules (“Official Rules”) and by the decisions of the Sponsor in all matters relating to the Sweepstakes.

3. Agreement to Official Rules. By entering the Sweepstakes, Participant unconditionally accepts and agrees to comply with and abide by these Official Rules as established by Sponsor. Sponsor reserves the right to alter any of these Official Rules at any time and for any reason. All decisions made by Sponsor concerning the Sweepstakes will be final and at its sole discretion.

4. How to Enter. To enter, Participant must complete the following items during the Entry Period: (i) follow @parcldigital and @theSuhs on TikTok; (ii) post a video on TikTok using the hashtag #ParclHomeGiveaway communicating how you have been negatively impacted by the housing crisis; and (iii) complete an application form available at https://giveaway.hoa.house/.

Parcl along with The Suh Family Foundation will pick a group of five (5) finalists, based on but not limited to the participant who has a combination of the most moving story and engagement on their video by our community. 

The performance of an entry is solely the responsibility of Participant. All entries must be received during the Entry Period in these Official Rules to be eligible. Sponsor is not responsible for late entries that are not received in a timely manner, or that are late due to computer or electronic malfunction, or due to inaccessibility of the internet or portions of the internet. Sponsor may, in its sole discretion, disqualify entries that do not fully comply with these Official Rules. Sponsor makes the final determination as to which entries are eligible to take part in this Sweepstakes and be considered for a prize. Entries that violate these Official Rules, as determined by Sponsor, in its sole discretion, will be disqualified from the Sweepstakes. 

5. Prize. One (1) winner (“Winner”) will receive up to one hundred thousand dollars ($100,000) (the “Cash Prize”) to be used exclusively for a down payment, mortgage and taxes on a residential real property.  

The Cash Prize will be distributed to each Winner via The Suh Family Foundation. Each Winner is subject to verification of eligibility, including verification of age and residency.

6. Prize Restrictions. Prize is not transferable and not assignable. All Prizes are subject to availability. No substitutions of Prize will be allowed, except Sponsor reserves the right to substitute Prize of comparable or greater value in the event a Prize, or any portion thereof, becomes unavailable for any reason. Prize is provided “as is” without warranty of any kind.

7. Odds of Winning. Participant’s odds of winning depend on the number of eligible entries performed during the Entry Period. Preference will be given to cities disproportionately affected by the current housing crisis.

8. Selection of Winners. During the week of June 6, 2022 through June 13, 2022, the Winner will be selected from all eligible entries received via a random drawing administered electronically by Sponsor. Sponsor is the sole party responsible for distribution of the Cash Prize to Winner.

9. Notification to Potential Prize Winners & Requirements of Prize Winner. Sponsor will attempt to provide Prize notification to the potential Prize Winners by Direct Message on Tik Tok account associated with Participant at the time of entry. Prize Winners will be required to execute an Affidavit of Eligibility, Release of Liability, and Prize Acceptance Form (collectively, the “Prize Claim Documents”). If a potential Prize Winner fails respond to Sponsor’s first winner notification message within forty-eight (48) hours of notification or after two (2) notification attempts (whichever occurs first) or refuses to sign and return the Prize Claim Documents within ten (10) business days after the date the Prize Claim Documents are sent to the Winner by the Sponsor and/or Sweepstakes Parties, the potential Prize Winner may be disqualified and the Prize will be forfeited in its entirety and an alternate Winner will be randomly drawn from the remaining eligible entries. Sponsor reserves the right to select an alternate Winner or not award the unclaimed Prize. Prize Winners are solely responsible for all taxes and fees or costs associated with any Prize, including but not limited to any federal or state or other income tax. 

If, in the Sponsor’s opinion, there is any suspected or actual evidence of electronic or non-electronic tampering with any portion of the Sweepstakes, or if a computer virus, bug, unauthorized intervention, fraud, technical difficulties, or failures compromise or corrupt or affect the administration, integrity, security, fairness, or proper conduct of the Sweepstakes, and/or the Sweepstakes is not capable of being conducted as described in these Official Rules, Sponsor and/or Sweepstakes Parties shall have the right, at their sole discretion, to disqualify any individual who tampers with the entry process and to void any entries submitted fraudulently, and/or to cancel, terminate, modify or suspend this Sweepstakes, and conduct a random drawing to select the Prize Winner from all non-suspect entries received prior to action taken, or as otherwise deemed fair and appropriate by Sponsor and/or Sweepstakes Parties. Sponsor and/or Sweepstakes Parties reserve the right to prosecute any fraudulent entries to the fullest extent of the law.

10. Intellectual Property. Participant grants Sponsor and/or Sweepstakes Parties a license to publish, display, and otherwise use Participant’s name, image, and likeness in connection with the Sweepstakes or for advertising and promotional purposes of Sponsor and/or Sweepstakes Parties, in perpetuity throughout the universe and in any medium or format whatsoever, without further consent from or any royalty, payment, or other compensation to Participant, and at Sponsor’s discretion. Participant represents and warrants that he or she has the right to grant the foregoing license.

11. Disputes. Sponsor is not responsible for any typographical or other error in the printing of the offer or administration of the Sweepstakes or in the announcement of the prizes, including, without limitation, errors in the printing or display of the offer and official rules, selection, notification and announcement of the Winners, or distribution of the Prizes. In the event of any ambiguity or error(s) in these Official Rules, Sponsor reserves the right to clarify or modify these Official Rules however it deems appropriate to correct any such ambiguity or error(s). If due to an error or for any other reason, more legitimate Prize claims are received than the number of Prizes stated in these Official Rules, Sponsor reserves the right to award only one (1) Prize from a random drawing from among all eligible Participants. In no event will more than the stated number of Prizes be awarded.

12. Waiver of Privacy and Release by Participant. By submitting an entry to the Sweepstakes, Participant acknowledges and agrees that entries submitted may be made available on Twitter and Instagram for viewing and comment on by the public, and understands that comments with which Participant disagrees of is unhappy about may be published or other become associated with any entry. By submitting an entry to the Sweepstakes, Participant waives any privacy expectations with respect to any entry submitted to the Sweepstakes. This Sweepstakes is in no way sponsored, endorsed, or administered by, or associated with TikTok.

13. Limitation of Liability and Release by Participant. TO THE FULLEST EXTENT PERMITTED BY LAW, PARTICIPANT AGREES (I) SPONSOR SHALL NOT BE RESPONSIBLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, PUNITIVE OR SPECIAL DAMAGES ARISING OUT OF OR CONNECTED WITH (A) THE SWEEPSTAKES, (B) ANY PRIZE AWARDED, OR (C) PARTICIPANT’S USE OF OR ACCESS TO THE SPONSOR’S TWITTER OR INSTAGRAM ACCOUNT AND (II) PARTICIPANT’SREMEDIES FOR ANY CLAIMS RELATING THE SWEEPSTAKES ARE LIMITED TO PARTICIPANT’S ACTUAL OUT-OF-POCKET EXPENSES OF PARTICIPATION IN THE SWEEPSTAKES (IF ANY). PARTICIPANT AGREES TO RELEASE AND HOLD HARMLESS SPONSOR, ITS SWEEPSTAKE PARTIES, OFFICERS, DIRECTORS, EMPLOYEES, AFFILIATED COMPANIES, AGENTS, SUCCESSORS, ASSIGNS, TWITTER, INSTAGRAM, PAYPAL, AND STASH FROM AND AGAINST ANY AND ALL LIABILITY, CLAIMS, COSTS, INJURIES, LOSSES, DAMAGES, OR CAUSE OF ACTION OF ANY KIND, DIRECTLY INDIRECTLY, WHETHER CAUSED BY NEGLIGENCE, ARISING OUT OF, OR IN CONNECTION WITH, PARTICIPANT’S PARTICIPATION IN THE SWEEPSTAKES, INCLUDING WITHOUT LIMITATION, THE UNAUTHORIZED OR ILLEGAL ACCESS TO PERSONALLY IDENTIFIABLE OR SENSITIVE INFORMATION OR ACCEPTANCE, POSSESSION, USE, MISUSE, OR NONUSE OF THE PRIZE OR ANY PORTION THEREOF; (II) TECHNICAL FAILURES OF ANY KIND, INCLUDING BUT NOT LIMITED TO THE MALFUNCTIONING OF ANY COMPUTER, MOBILE DEVICE, CABLE, NETWORK, HARDWARE OR SOFTWARE; (III) THE UNAVAILABILITY OR INACCESSIBILITY OF ANY TRANSMISSIONS OR TELEPHONE OR INTERNET SERVICE; (IV) UNAUTHORIZED HUMAN INTERVENTION IN ANY PART OF THE ENTRY PROCESS OR THE SWEEPSTAKES, OR (V) ELECTRONIC OR HUMAN ERROR WHICH MAY OCCUR IN THE ADMINISTRATION OF THE SWEEPSTAKES OR THE PROCESSING OF ENTRIES, INCLUDING, WITHOUT LIMITATION, INCORRECT, DELAYED OR INACCURATE TRANSMISSION, WINNER NOTIFICATIONS, PRIZE CLAIMS OR OTHER INFORMATION OR COMMUNICATIONS RELATING TO THE SWEEPSTAKES, OR THE FAILURE TO CAPTURE OR TRANSMIT ANY SUCH INFORMATION OR ANY ERRORS IN THESE OFFICIAL RULES.

14. Privacy Notice. Personal information provided by Participant to enter the Sweepstakes may be shared as may be necessary for the purposes of conducting the Sweepstakes and awarding Prizes. Sponsor, its affiliates, and companies supplying prizes (or parts thereof) in connection with this Sweepstakes may from time-to-time contact Participant via email, Direct Message on Twitter, and/or Instagram Direct Messenger via the Twitter or Instagram account associated with Participant concerning the Sweepstakes, and each Participant consents to receiving such communications via email, Direct Message on Twitter, and/or Instagram Direct Messenger. Personal information provided to enter the Sweepstakes will not be sold, rented, transferred, or otherwise disclosed to third parties other than as described above.

15. Sponsor’s Reservation of Rights. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. If any provision of these Official Rules is held to be invalid or unenforceable, such provision shall be struck, and the remaining provisions shall be enforced. If for any reason the Sweepstakes is not capable of being safely executed as planned, including, without limitation, as a result of war, natural disasters or weather events, labor strikes, acts of terrorism, pandemic infection (including without limitation, events related to the COVID-19 virus), or other force majeure event or infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures or any other causes which in the opinion of Sponsor, corrupt or affect the administration, security, fairness, integrity, or proper conduct and fulfillment of this Sweepstakes, Sponsor reserves the right to cancel, terminate, modify or suspend the Sweepstakes. In the event of any cancellation, termination or suspension, Sponsor reserves the right to select a winner from a random drawing from among all eligible, non-suspect entries received as of the date of the termination, cancellation or suspension.

16. Governing Law. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of Participant and Sponsor in connection with the Sweepstakes, will be governed and construed in accordance with the laws of the State of New York, without giving effect to any choice of law or conflict of law that would cause the application of the laws of any jurisdiction other than the State of New York.

17. Sweepstakes Results and Official Rules. To obtain the identity of the Prize Winners and/or a copy of these Official Rules, send a self-addressed stamped envelope to Jaffe Law, Attention: The Suh Family Foundation Homeowners Association Sweepstakes, 27777 Franklin Road, Suite 2500, Southfield, MI 48034.  Requests must be received no later than December 31, 2022.Severability:  If any provision of these Official Rules shall be held invalid, illegal, or unenforceable, such provision shall be enforced to the maximum extent permitted by law and the Sponsor’s fundamental intentions hereunder, and the remaining provisions shall not be affected or impaired, provided, however, that in such cases the parties oblige themselves to use their best efforts to achieve the purpose of the invalid provision by a new legally valid stipulation.
